Article 2: General

The e-commerce website of Plaatvis offers its customers the possibility to purchase products from its webshop online.
 
These General Terms and Conditions ("Conditions") apply to every order placed by a visitor to this e-commerce website ("Customer"). When placing an order via the AfterMoon Studios webshop, the Client must explicitly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions to the exclusion of all other terms and conditions. Additional terms and conditions of the client are excluded, unless they have been previously, explicitly and in writing accepted by Plaatvis.

Article 3: Price

All prices stated are expressed in EURO, always including VAT and all other taxes or taxes to be borne by the Customer.

All prices mentioned on the site do not include shipping costs. The total price will be stated in your order confirmation. Any  delivery, reservation or administrative costs will be mentioned separately.  

If an incorrect price has been communicated due to an error, Plaatvis will immediately correct it and inform the customer. In the event of a price change, the customer has the right to rene abolish the purchase.

The indication of price refers exclusively to the articles as the verbatim described. The accompanying photos are intended to be decorative and may contain elements that are not included in the price.

Article 4: stock

Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Plaatvis.  Plaatvis is only obliged to an obligation of means with regard to the accuracy and completeness of the information provided. Plaatvis is in no way liable in the event of  manifest  material errors, typesetting or printing errors.

If the Customer has specific questions about, for example, sizes, color, availability, delivery time or delivery method, we request the Customer to contact our customer service in advance.

The offer is valid at any time while stocks last and can be adjusted or withdrawn at any time by Plaatvis. Plaatvis cannot be held liable for the unavailability of any product. If  an offer has a limited period of validity or is made under conditions, this will be explicitly stated in the offer.

Article 5: Online purchases
 

Placing an order is done by adding product(s) in the shopping cart. After this, the customer chooses shipping or pick up. With the shipping option, further shipping costs will be charged. If the customer opts for a pick-up, he will receive an email with possible pick-up times within 24 hours after receipt of payment.

The customer chooses a payment method and completes the order further. After completing the order, the customer will receive an automatic email with the order overview.
If the customer has opted for a transfer with payment method, this is now binding and the customer is obliged to pay.

The Customer has the choice between the following paymentmethods:

  • by bank card ( Bancontact, Ideal or Sofort )
  • by Paypal ( not available in Belgium or the Netherlands )
  • by bank transfer to account number BE19 1030 6921 3612

Plaatvis is entitled to refuse an order due to a serious shortcoming of the Customer with regard to order and in which the Customer is involved.

For the online payment, we work together with Mollie to ensure the security of the online transaction. If the customer is refused payment by his bank/financial institution, the order will be postponed. In the event of refusal, Plaatvis  can under no circumstances be held responsible for any delays in the delivery / non-delivery.

Article 6: Delivery and execution of the agreement

Items ordered through this webshop are delivered in Europe. For sending packages we work together with MyParcelBE and Sendcloud.

Plaatvis will ship the package up to 4 business days after receiving payment. Weekends and holidays or holidays announced by us are therefore excluded from this.

Unless otherwise agreed or expressly provided otherwise, the goods will be delivered to the Customer's place of residence within 30 days of receipt of the order.

This is to the exception of custom-made products. In this case, the entire order will only be shipped when all the products of the order are ready.  
Any visible damage and /or qualitative shortcoming of an article or other shortcoming in the delivery, must be reported by the Customer immediately to Plaatvis.

Plaatvis is not liable for damages that the customer or a third party suffers from the use of an item supplied by us. Plaatvis can also not be held liable if an article does not correspond to the customer's expectations after the customer has used it.

Under no circumstances will the customer automatically be eligible for any compensation for his direct or indirect costs and damages.

In case of incorrect delivery or damage, replacement will be at the costs of Plaatvis.

The address details provided by the customer constitute a commitment for him: in the event of a mistake in this data, Plaatvis cannot be held liable for the impossibility in which he might find himself to deliver the ordered product. In the case of a second shipment, the actual shipping costs will always be charged.

The risk of loss or damage is transferred to the Customer as soon as he (or a third party designated by him, who is not the carrier) has acquired physical possession of the goods. However, the risk is already transferred to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by Plaatvis.  

Article 7: Retention of title

The delivered items remain the exclusive property of Plaatvis until the moment of full payment by the Customer.
The Customer undertakes, if necessary, to inform third parties of the retention of title of Plaatvis,  e.g. to anyone who would seize the items that have not yet been fully paid for.

Article 8: Right of Withdrawal

The provisions of this article only apply to Customers who, in their capacity as consumers, purchase items online from Plaatvis.

The Customer has the right to withdraw from the agreement within a period of 14 days without giving reasons.

The withdrawal period expires 14 days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, acquires physical possession of the good.
In order to exercise the right of withdrawal, the Customer must inform Plaatvis, Mirthe De Clerck,  Fruithoflaan  28, 2960 Sint-lenaarts, Belgium,  info@plaatvis.be by means of a statement  (e.g. in writing by post or e-mail) of his decision to withdraw from the agreement.

In order to comply with the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to Plaatvis,  Fruithoflaan  28, 2960 Sint-Lenaarts, Belgium, without delay, but in any case no later than 14 days after the day on which he has communicated his decision to withdraw from the agreement to Plaatvis. The Customer is on time if he returns the goods before the period of 14 days has expired.

The direct costs of returning the goods will be borne by the Customer. The cost is estimated at a maximum of approximately EUR 40

If the returned product has been reduced in value in any way, Plaatvis reserves the right to hold the Customer liable and to claim compensation for any depreciation of the goods resulting from the use of the goods by the Customer that goes beyond what is necessary due to its nature, determine the characteristics and functioning of the goods.

Only items that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.

If the Customer withdraws from the agreement, Plaatvis will refund to the Customer all payments received from the Customer up to that moment, including the standard delivery costs, within a maximum of 14  days after Plaatvis has been informed of the Customer's decision to withdraw from the agreement. In the case of sales agreements,  Plaatvis may wait with the refund until it has received all the goods, or until the Customer has demonstrated that he has returned the goods, whichever comes first.

Any additional costs resulting from the Customer's choice of a method of delivery other than the cheapest standard delivery offered by Plaatvis will not be refunded.

Plaatvis will reimburse the Customer using the same means of payment as the Customer made the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged for such reimbursement.

The Customer cannot exercise the right of withdrawal for:

 
  • the delivery of goods manufactured according to the Customer's specifications, or which are clearly intended for a specific person
  • the supply of digital content that has not been delivered on a tangible medium, if the performance has started with the customer's explicit prior consent and provided that the Customer has acknowledged that he thereby loses his right of withdrawal (e.g. downloading music, software);
Article 9: Guarantee

Under the Law of 21 September 2004 on the protection of consumers when selling consumer goods, consumers have legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee leaves these rights unaffected.

In order to invoke the warranty, the Customer must be able to present proof  of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer's home, the Customer must contact the Plaatvis customer service and return the item to Plaatvis at his expense.

In the event of a defect being found, the Customer must inform Plaatvis as soon as possible. In any case, any defect must be reported by the Customer within a period of 2 months after its discovery. Afterwards, any right to repair or replacement expires.

The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article in violation of the purpose for which it was designed, non-compliance with the instructions for use or manual, adjustments or changes to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, subject to proof to the contrary by the Customer.

Article 10:  Customer service

The customer service of Plaatvis can be reached by e-mail on  info@plaatvis.be or by post at the following address Plaatvis, Mirthe De Clerck,  Fruithoflaan  28, 2960 Sint-Lenaarts, Belgium. Any complaints can be addressed to this.

Article 11: Penalties for non-payment

Without prejudice to the exercise of other rights that Plaatvis  has, the Customer owes an interest of 10% per year on the unpaid amount by operation of law and without notice of default from the date of the non-performance by operation of law and without notice. In addition, the Customer owes, by operation of law and without notice, a fixed compensation of 10% on the amount in question, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, Plaatvis reserves the right to take back the items not (fully) paid.

Article 12: Privacy

Plaatvis respects the Belgian law of 8 December 1992 regarding the protection of privacy in the processing of personal data.

The personal data you have provided will only be used for the following purposes: Processing and sending the order and sending newsletters if the customer has indicated that he agrees to this.

You have a legal right to inspect and possibly correct your personal data. Subject to proof of identity (copy of identity card), you can obtain the written notification of your personal data Info@aftermoon-studios.com free of charge via a written, dated and signed request to Plaatvis, Fruithoflaan 28, 2960 Sint-Lenaarts, Belgium.  If necessary, you can also ask to correct data that would be incorrect, not complete, or not pertinent.

We treat your data as confidential information and will not pass it on, rent or sell it to third parties.

Plaatvis works together with a number of companies. Plaatvis works together with TheShopBuilders for the maintenance and server of the webshop.
For the online payment,  Plaatvis works together with Mollie to ensure the security of the online transaction. For the shipping process, Plaatvis works together with MyParcelBE and Sendcloud. Plaatvis is not liable for misuse of this data by third parties.

It is possible that the obtained personal data will be passed on to companies cooperating with us. In the event that we pass on the data to others such as the aforementioned companies, Plaatvis always asks permission from the customer in advance.

The customer is responsible for keeping his login details confidential and the use of his password. Your password is stored encrypted, so Plaatvis does not have access to your password.

Plaatvis keeps online (anonymous) visitor statistics in order to see which pages of the website are visited to what extent.

Article13: Use of cookies

During a visit to the site, 'cookies' can be placed on the hard drive of your computer. A cookie is a text file that is placed by the server of a website in the browser of your computer or on your mobile device when you consult a website. Cookies cannot be used to identify individuals, a cookie can only identify a machine.

For a detailed explanation of the various cookies that Plaatvis uses, we refer you to the Privacy Policy.

You can set your internet browser in such a way that cookies are not accepted, that you receive a warning when a cookie is installed or that the cookies are subsequently deleted from your hard drive. You can do this via the settings of your browser (via the help function). Keep in mind that certain graphic elements may not appear correctly, or that you will not be able to use certain applications.

By using our website, you agree to our use of cookies.

Article 14: Infringement of validity - non-renunciation

If any provision of these Terms and Conditions is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions. The failure at any time by Plaatvis to enforce any of the rights listed in these Terms and Conditions, or to exercise any right thereof, shall never be considered as a renunciation of such provision and shall never affect the validity of these rights.

Article 15: Change of conditions

These Terms and Conditions are supplemented by other conditions that are explicitly referred to, and the general terms and conditions of sale of AfterMoon Studios. In the event of any inconsistency, these Terms and Conditions shall prevail.

Article 16: Proof

The Customer accepts that electronic communications and back-ups can serve as evidence.

Article 17: Toepasselijk recht – Geschillen

Belgian law applies, with the exception of the provisions of private international law relating to applicable law.

The courts of the Consumer's place of residence are competent in the event of legal disputes. The Consumer can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).

Article 18: Intellectual property rights

The content of this site, including the brands, logos, drawings, data, product or company names, texts, images, etc. are protected by intellectual rights and belong to Plaatvis or entitled third parties and can under no circumstances be copied or used.
